Abstract

Equity and public law are more closely linked than may be apparent to the casual observer.1 It is now almost 30 years since the Chief Justice of Australia, Sir Anthony Mason, commented in an extra-curial paper that: In the field of public law, equitable relief in the form of the declaration and the injunction have played a critical part in shaping modern administrative law which, from its earliest days, has mirrored the way in which equity has regulated the exercise of fiduciary powers.
