Abstract
A paper on the extent to which war justifies 'special cases' of extra-judicial service by Australian High Court judges is presented. The focus is on an exchange of letters between Chief Justice Sir John Latham and Prime Minister Robert Menzies in June 1940. In addition, the paper examines how wartime or emergency conditions can change established constitutional perceptions regarding the relations between senior members of the judiciary and government.
