Abstract

Under the Matrimonial Causes Act 1959 we were too much concerned with matrimonial fault. Nevertheless, Section 86 of the Matrimonial Causes Act was a real and important step forward in Family Law. Its successor, section 79 of the Family Law Act, is a much better provision, though possibly not perfect. The ideal criteria to guide the court in dealing with matters of family property may not be easily established
